Terms and Conditions

Introduction

These General Terms and Conditions (“General Conditions”), together with the information included in the booking confirmation email (“Booking Confirmation Email”), constitute the terms under which Bookingbt.it agrees to make the Services available on the Website (as defined below). These General Conditions, the Booking Confirmation Email, and the applicable Rules and Restrictions represent the terms under which the Travel Service Providers agree to provide the Services to the Customer.

Bookingbt (as defined below) offers its Customers the possibility to book, through the website www.bookingbt.it, airline tickets and travel insurance. Only Customers who have previously read and unconditionally accepted these General Conditions as part of the booking process may benefit from the Services offered by Bookingbt (as defined below) and by Third-Party Providers through this Website. If a Customer does not accept these General Conditions, it will not be possible to complete the booking. These General Conditions have been in force since 01/10/2021.

Customers agree to comply with the obligations contained in these General Conditions. The contract between the Customer and the relevant Travel Service Provider enters into force as soon as Bookingbt provides written confirmation of the booking to the Customer via the Booking Confirmation Email. When making a booking, Customers must save and/or print a copy of these General Conditions for future reference.

1.2 Scope and Relationship with Bookingbt

Bookingbt operates the Website, which acts as an interface between the Customer and the various Travel Service Providers offering Services. When a booking for a Service is made through the Website, a contract is concluded with the relevant Travel Service Provider for that Service.
These General Conditions apply to the offering and provision of Services through this Website and incorporate all applicable Rules and Restrictions made available to the Customer before the booking is completed and accepted by the Customer at the time of booking. It is the Customer’s responsibility to review these General Conditions and the applicable Rules and Restrictions.
Bookingbt may amend these General Conditions at any time without prior notice, and the Rules and Restrictions may be modified by the relevant Travel Service Provider. Such changes shall not apply to bookings already accepted by Bookingbt on behalf of the relevant Travel Service Provider. Therefore, it is essential that the Customer reads, saves, and/or prints a copy of the General Conditions at the time the booking is made in order to be aware of the applicable provisions.

Article 2. Booking through the Website
2.1 Customer Obligations

The Website assists the Customer in finding travel services and making the necessary bookings, and acts as an interface in transactions carried out with Travel Service Providers. The Booking Customer must be at least eighteen years old, have the legal capacity to enter into contracts, and at the time of booking, have the necessary authorization or authority to act on behalf of all persons included in the booking. The Customer must use the Website in compliance with these General Conditions and the Website’s Terms of Use.

The Booking Customer warrants and confirms that all details provided in connection with the booking are complete and accurate, and that all parties have agreed to be bound by these General Conditions. The Booking Customer confirms that they have the authority to accept, and do accept, these General Conditions on behalf of all travelers included in the booking.

The Booking Customer is the person responsible for the booking, for paying any deposits and the full price, for making any requests for amendments or cancellations, and for paying any additional charges related to the booking.

The Booking Customer agrees to check all descriptions in the travel documents received after booking and to notify Bookingbt immediately in case of any errors or discrepancies, including cases where personal details do not match those shown on the passports of the travelers included in the booking.

The Booking Customer is responsible for any activity carried out through the Website (whether financial or otherwise) and is also responsible for any consequences resulting from the possible use of their name and password to access the Website. The Customer guarantees the accuracy of the personal information entered on the Website, including information concerning any accompanying travelers.

Any fraudulent use of the Website or use that conflicts with these General Conditions shall constitute grounds for denying the Customer access to the Services offered by Bookingbt and Third-Party Providers, as well as to other functionalities of the Website.

2.2.1 Confirmation

The Booking Confirmation Email, which includes the essential details of the booking such as a description of the booked Service(s) and the price, will be sent to the Booking Customer by email. If the Booking Customer does not receive the Booking Confirmation Email within 24 hours of making a booking, they must contact Customer Service by email at verona@bismillahtravel.com or by telephone at +39 045 9231 728 09:30–13:00 and 15:00–19:00 Mon–Fri, Sat 09:30–13:00 – at the cost of a national call).

The data stored in the IT systems of Bookingbt and/or its Third-Party Providers shall constitute proof of the bookings made by the Booking Customer. Data stored on computer systems or electronic media therefore constitute valid proof and shall be accepted under the same conditions and with the same evidentiary value as a written paper document.

2.2.2 Cancellation

Without prejudice to the provisions of paragraph 3.5 relating to Holiday Packages, cancellations may be made by sending an email to verona@bismillahtravel.com or by calling Customer Service at +39 045 9231 728 (09:30–13:00 and 15:00–19:00 Mon–Fri, Sat 09:30–13:00 – at the cost of a national call). All requests will be processed on behalf of the respective Travel Service Providers.

In the event of a total or partial cancellation of a booking, a charge may be applied to cover costs already incurred in organizing the trip. Additional costs may also be charged by the relevant Third-Party Provider – please refer to the Rules and Restrictions made available during the booking process for further details.
If a cancellation concerns more than one traveler within a single booking, any cancellation fees will be applied to each traveler within the same booking. In some cases, cancellation fees charged by Third-Party Providers may amount to the full value of the booked trip, in which case no refund will be made to the Customer. Partial cancellation, meaning the cancellation of an individual service, will not be possible without forfeiting the amount paid for that specific service.

Bookingbt applies administrative fees in case of cancellation or modification of a flight booking. However, additional charges may be applied by the respective Third-Party Provider – for details, refer to the Rules and Restrictions available during the booking process.

If the Customer fails to appear at the time of departure (“no-show”), refunds will only be made to the extent provided by the relevant Rules and Restrictions of the individual Providers made available during the booking process.

2.2.3 Modification of the Booking

Without prejudice to paragraph 3.5, if, after making a booking, the Customer wishes to change the flight date, destination, or place of departure, such changes may be requested (if permitted by the booking) by sending an email to verona@bismillahtravel.com or by calling Customer Service at +39 045 9231 728 (09:30–13:00 and 15:00–19:00 Mon–Fri, Sat 09:30–13:00 – at the cost of a national call).

In case of modification of a booking, an additional fee may be charged by the Third-Party Provider – for further details, please refer to the Rules and Restrictions made available during the booking process.

2.2.4 Refunds

Where a refund is due to the Customer, the relevant amounts, net of any necessary deductions, will be reimbursed by the party that received the original payment (either Bookingbt and/or a Third-Party Provider, as indicated on the Customer’s credit card or account statement) to the same card used for the original transaction.

Any applicable booking fees will not be refundable, except as provided in paragraph 3.5.

In the case of flight booking refunds, processing may take up to six months, except as otherwise provided in paragraph 3.3.

2.3 Travel Documents

The travel documents required for any Service requested through the Website will be sent to the email address provided by the Booking Customer at the time of booking.

Bookingbt or the Travel Service Provider shall not be held responsible if the delivery or availability of travel documents becomes impossible due to an error made by the Booking Customer in providing their personal data or email address.

2.4 Payment

The prices of Services booked on the Website or by telephone must be paid either (i) to Bookingbt and/or (ii) directly to Third-Party Providers. The payment may be charged by more than one party (as indicated on the Customer’s credit card or bank statement); in any case, the total amount charged will not exceed the total price of the Services.

The Customer must provide their credit card details, and the Third-Party Provider or Bookingbt will verify the availability of funds (subject to a limited pre-authorization procedure confirmed by the Customer’s issuing bank).

Some banks and credit card companies apply fees for international or cross-border transactions. For example, if a booking is made using an Italian credit card with a non-Italian vendor, the bank may apply a cross-border or international transaction fee. Furthermore, an international trip booking may be treated as an international transaction by the bank or credit card company, since Bookingbt transmits card details to an international travel supplier for charging purposes.
If the Customer has questions regarding such fees or the exchange rate applied, they should contact their bank.

Bookingbt will subsequently send the Customer a confirmation email in accordance with paragraph 2.2.1 above. The confirmation email will include a copy of the purchase details, which will also be available in the “Bookings” section of the Website.
If any information is incorrect or the Customer does not receive the confirmation email within 24 hours, they must contact Customer Service immediately at the number provided in the confirmation email or at +39 045 9231728 (09:30–13:00 and 15:00–19:00 Mon–Fri, Sat 09:30–13:00 – at the cost of a national call).

Payment for the selected Service is made in full by the Customer at the time of purchase via credit card. If the issuing bank refuses the payment, the purchase will be suspended, and no charges will be applied to the Customer.

If other issues occur, such as a failed transaction or a booking problem, temporary authorization holds may appear on the Customer’s credit card for an amount equal to the total or partial cost of the intended purchase. In such cases, Bookingbt does not make any actual charges to the Customer’s account. If funds are held on the Customer’s credit card, the Customer must send an email to verona@bismillahtravel.com or call Customer Service at +39 045 9231728. Once BookingBT is informed of the hold and the request to release funds has been transmitted to the bank, the release time is determined by the issuing bank and interbank systems. Bookingbt will do its best to assist the Customer to ensure a prompt release.

Note: Before proceeding with the purchase of the selected Service, the Customer must ensure that their account has sufficient funds to cover all selected services. If insufficient funds are available, the attempted purchase may result in a temporary hold of funds until the issuing bank and international credit card associations formally release the amount.

Article 3. Services and Special Conditions

Bookingbt operates the Site, which acts as an interface between the Customer and the Travel Service Provider with regard to the offer and provision of all Services.

The purpose of this section is to provide some information regarding the terms and conditions for the use of Services provided by Travel Service Providers in order to inform Customers. This preliminary information is not exhaustive and does not replace the applicable Rules and Restrictions. In the event of any conflict or inconsistency between these General Terms and the incorporated Rules and Restrictions, the Rules and Restrictions shall prevail. The Rules and Restrictions are made available prior to booking.

Unless otherwise stipulated by law, this preliminary information does not create any obligation or liability on the part of Bookingbt.

Article 4. Travel Information, Prices, and Insurance
4.1 Travel Destinations

Although most trips, including international travel, do not involve risks or incidents, some destinations may present higher risks than others. Before booking travel to international destinations, Bookingbt encourages Customers to review any travel bans, warnings, notices, and advice issued by the Crisis Unit, available at: http://www.viaggiaresicuri.it.

By offering travel to certain international destinations, Bookingbt does not guarantee that travel to such destinations is advisable or risk-free and cannot be held liable for damages or losses resulting from travel to these destinations.

4.2 Prices and Information on the Site

The price of Services will be the one indicated on the Site at the time, except in cases of obvious material error. Prices are subject to change at any time; however, such changes will not affect bookings already accepted.

Although Bookingbt strives to avoid errors, the price of some Services listed on the Site may be incorrect. Bookingbt RESERVES THE RIGHT TO CORRECT ANY OBVIOUS MATERIAL ERROR IN PRICING, ON THE SITE AND/OR REGARDING BOOKINGS MADE AT AN INCORRECT PRICE. IN SUCH CASES, WHENEVER POSSIBLE, BOOKINGBT WILL OFFER THE CUSTOMER THE OPTION TO EITHER MAINTAIN THE BOOKING AT THE CORRECT PRICE OR CANCEL THE BOOKING WITHOUT PENALTIES.

Bookingbt is under no obligation to provide Services at an erroneously listed lower price, even after the Customer has confirmed the booking.

4.3 Insurance

Prices listed on the Site do not include travel insurance.

Customers are encouraged to obtain insurance covering potential consequences in the event of cancellations, including coverage for extraordinary risks such as repatriation costs in case of accident or illness.

It is the Customer’s responsibility to ensure that the insurance obtained is adequate for their needs. Occasionally, travel insurance products may be presented during the booking process for purchase.

Details of the insurer, key information, and terms and conditions will be shown during the booking process.

Article 5. Customer Service and Complaint Management

Questions, information requests, or complaints should be sent by email to verona@bismillahtravel.com or by calling Customer Service at +39 045 9231 728 (09:30–13:00 and 15:00–19:00 Mon–Fri; Sat 09:30–13:00 – national call rates apply).

For complaints, Customers may also send them to: Bookingbt Via XX Settembre 45, 37129 – Verona, Italy.

To facilitate processing, Customers are encouraged to submit complaints within 30 days of the end of a trip.

In general, complaints will only be processed if the issues mentioned in the email were reported via verona@bismillahtravel.com or by calling Customer Service at(09:30–13:00 and 15:00–19:00 Mon–Fri; Sat 09:30–13:00 – national call rates apply) during the trip (or as soon as reasonably possible), or to the carrier if the dispute arises during outbound or return travel, to enable timely action to resolve the issue and mitigate any loss to the Customer. Exceptions may apply depending on the circumstances.

Complaints concerning loss, theft, or damage to baggage, clothing, or personal items that were not under the Customer’s control during the stay must be directed to the relevant Third-Party Supplier.

Furthermore, pursuant to Legislative Decree 28/2010 and subsequent amendments, the Customer may access mediation for the settlement of any dispute with Bookingbt under the conditions established by the entity chosen by the Customer to administer the procedure.

The European Commission’s Online Dispute Resolution platform is available at: http://ec.europa.eu/odr.

Article 6. Bookingbt’s Liability

With regard to the purchase of Services, Bookingbt acts as an intermediary between the Customer and the Travel Service Provider and, therefore, Bookingbt (even when charging the price) shall not be held liable for any failure by the Travel Service Providers to fulfill their obligations related to the Services provided to the Customer.

Travel service providers supply Bookingbt with the information describing the services you see on the Bookingbt Site, including service details, photographs, rates, and terms and conditions. Travel service providers are responsible for ensuring that such information is accurate, complete, and up to date. Bookingbt shall not be liable for any inaccuracies in this information, except and only to the extent that it is directly responsible for such inaccuracies, including hotel ratings provided for guidance only and not considered official.

Consumers may exercise the rights granted by law. The exclusions and limitations contained in these General Terms and Conditions apply only to the extent permitted by law. Nothing in these General Terms and Conditions can exclude or limit Bookingbt’s liability in cases of fraud, gross negligence, breach of contract, personal injury, or death caused by Bookingbt’s negligence.

Pursuant to Articles 47 (letters g) and m)) and 59(1)(n) of the Consumer Code, the right of withdrawal provided for in Articles 52 et seq. of the Consumer Code does not apply.

Article 8. Disclaimer

Article 9. Applicable Law

These General Terms and Conditions are governed by Italian law, excluding the applicability of Law 218/95 (“Reform of the Italian Private International Law System”). The Customer agrees that the Italian courts shall have jurisdiction over any dispute arising from or related to the interpretation of these General Terms and Conditions.

Article 10. Dispositions finales

If Bookingbt does not at any time make use of any of the provisions of the General Terms and Conditions, this shall not be interpreted as a waiver of the right to invoke such provision at a later time.

If a court or other competent judicial authority should deem any provision, or part thereof, of these General Terms and Conditions invalid, unlawful, or unenforceable, that provision, or part thereof, shall not be considered part of this contract with the Customer to the extent required, and the remaining provisions shall remain applicable.

Any case of force majeure, including the interruption of communication means or a strike by carriers, hoteliers, or air traffic controllers, shall result in the suspension of the obligations contained in these General Terms and Conditions that are affected by the force majeure event, and the party affected by the force majeure event shall not be liable for the impossibility of fulfilling these obligations.

These General Terms and Conditions shall enter into force as of 1/12/2020.

Annex 1 – Standard Information Form on Travel Packages
Important information on your rights regarding the purchase of a travel package

Sometimes you may find yourself booking a Travel Package as a result of the various Services you choose to purchase. In such cases, Bookingbt shall be considered the organizer of the Travel Package, and the following important information shall apply.

The combination of travel services offered to you constitutes a package pursuant to Directive (EU) 2015/2302. Consequently, you will benefit from all EU rights applicable to packages. Bookingbt shall be fully responsible for the proper performance of the package in its entirety. Furthermore, as required by law, Bookingbt has a protection plan that guarantees the refund of your payments and, if transport is included in the package, your repatriation in case of insolvency.

Fundamental Rights pursuant to Directive (EU) 2015/2302

— Travelers shall receive all essential information about the package through the Bookingbt website prior to concluding the contract relating to the travel package.

— There is always at least one supplier responsible for the proper performance of all travel services included in the contract.

— Travelers shall be provided with an emergency phone number and/or the contact details through which the organizer or travel agent can be reached.

— Travelers may transfer the package to another person, with reasonable notice and possibly subject to additional costs.

— The package price may only be increased if specific costs (e.g., fuel prices) increase and if expressly provided for in the contract, and in any case no later than 20 days before the start of the package. If the increase exceeds 8% of the package price, the traveler may withdraw from the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction if the relevant costs decrease.

— Travelers may withdraw from the contract without incurring withdrawal fees and obtain a full refund of payments if any essential elements of the package, other than the price, change substantially. If, before the start of the package, the professional responsible for the package cancels it, travelers shall be entitled to a refund and, where applicable, compensation.

— Travelers may, in exceptional circumstances, withdraw from the contract before the start of the package without incurring withdrawal fees, for example, in the event of serious security issues at the destination that may compromise the package.

— Furthermore, travelers may at any time, prior to the start of the package, withdraw from the contract upon payment of reasonable and justified withdrawal fees.

— If, after the start of the trip, substantial elements of the package cannot be provided as agreed, suitable alternative arrangements shall be offered at no additional cost. Travelers may terminate the contract without incurring fees if the services are not provided according to the contract and this significantly affects the execution of the package and the organizer has not remedied the issue.

— Travelers are also entitled to a price reduction and/or compensation for damages in case of non-performance or improper performance of travel services.

— The organizer is obliged to provide assistance if a traveler encounters difficulties during the trip.

— If the organizer or, in some Member States, the supplier becomes insolvent after the start of the package and if transport is included in the package, the repatriation of travelers is guaranteed.
Directive (EU) 2015/2302, as transposed into national legislation

Annex 2 – Standard Information Form on Linked Travel Services
Important information on your rights regarding the purchase of a linked travel service

Sometimes you may find yourself booking a linked travel service as a result of the various Services you choose to purchase. In such cases, the following important information shall apply.

If, after selecting and booking a travel service, you book additional travel services for your trip or holiday through Bookingbt, you will not benefit from the rights that apply to packages under Directive (EU) 2015/2302. Therefore, Bookingbt shall not be responsible for the proper performance of individual travel services. In case of issues, please contact the relevant service provider.

However, if during the same visit to the Bookingbt website you book additional travel services for the same trip, such services shall become part of a linked travel service. In such cases, Bookingbt, as provided by EU law, has a protection plan to reimburse your payments for services not provided due to Bookingbt’s insolvency. This protection does not provide reimbursement in case of insolvency of the relevant service provider.

For more information on customer insolvency protection, you may contact the insurance company Allianz S.p.A. directly at Tel. +39 045 810 1422 or via email at: VERONA7@AGEALLIANZ.IT

Note: this insolvency protection does not cover contracts with third parties, other than Bookingbt, which may still be performed despite Bookingbt’s insolvency.
